City of Lorraine Ordinance to Establish Height of Weeds and Grasses

State of Kansas, Ellsworth County, City of Lorraine:
ORDINANCE NO. 253
BEING ON ORDINANCE ESTABLISHING
THE MAXIMUM HEIGHT OF WEEDS AND GRASSES
ON OR ABOUT PROPERTY WITHIN THE CITY LIMITS
OF THE CITY OF LORRAINE, ELLSWORTH COUNTY, KANSAS; AND AMENDING THE CODE OF THE CITY
OF LORRAINE BY ADDING SECTION 8-404(d)
TO CHAPTER VIII ESTABLISHING FEES
FOR VIOLATION OF THIS ORDINANCE.
Be it Ordained by the Governing Body of the City of Lorraine, Kansas:
CHAPTER VIII. HEALTH AND WELFARE
Section 8-402(e). WEEDS.
Shall be amended to read as follows, to wit:
8-402. DEFINITIONS. (e) Weeds and grasses on or about property within the city limits of the City of Lorraine which, because of its height, has a blighting influence on the neighborhood. Any such weeds and indigenous grasses shall be presumed to be blighting if they exceed 6 (six) inches in height.
Section 8-404 ABATEMENT; ASSESSMENT OF COSTS.
Shall be amended by adding section (d) which reads as follows, to wit:
8-404. ABATEMENT; ASSESSMENT OF COSTS. (d) Violations of this ordinance shall incur an administrative fee plus no less than $50.00 per lot or the actual cost of cutting, destroying, and/or removing the weeds for each occurrence at any time during the current calendar year in which the public officer or an authorized assistant abates the nuisance upon the expiration of 10(ten) days after receipt of the notice required by section 8-403.
REVOCATION OF PRIOR ORDINANCE.
All prior ordinances in conflict with the hereinbefore described definition of subsection (e)in Article 8-402 are hereby repealed.
PUBLICATION AND EFFECTIVE DATE.
This ordinance shall be published once in the official city newspaper, the Ellsworth County Independent-Reporter, and shall take effect and be enforced from and after its publication.
