City of Ellsworth Resolution for Public Hearing on Annexation

A RESOLUTION OF THE CITY OF ELLSWORTH,
KANSAS ESTABLISHING A PUBLIC HEARING DATE
FOR THE CONSIDERATION OF ANNEXATION
OF CERTAIN REAL PROPER'IY TO THE CITY
OF ELLSWORTH, KANSAS.

WHEREAS, the governing body of the City of Ellsworth, Kansas is interested in the unilateral annexation of certain eligible property to the City of Ellsworth, Kansas pursuant to KS.A. 12-520 et. seq.; and
WHEREAS, the property consists of approximately 1.8 acres, is located on the northeast corner of Evans Street and Avenue JJ and is more accurately described as follows:
    A tract of land in the fractional Northeast
    Quarter of Section 21, Township 15 South,
    Range 8 Ellsworth, in Ellsworth County, Kansas,
    described as follows:
    thence west four hundred eighty (480.00')
    feet to a point on the East right-of-way line
    of Evans Street; thence Southeasterly
    along the property line, two hundred
    eighty (280.00') feet to the highway
    right-of-way line; thence East-Southeasterly
    along the highway right-of-way line, two
    hundred twenty-two (222.00') feet; thence
    South perpendicular to the Quarter (1/4)
    Section Line thirty (30.00') feet to a point four
    hundred sixty one (461.00') feet east of the
    Northwest corner of the Southeast Quarter
    (SE 1/4) Section Twenty-One (21); thence East
    along the North line of the Southeast Quarter
    (SE 1/4) of Section Twenty One (21) to the
    Northeast corner of the West Half of the
    Southeast Quarter (W 1/2 SE 1/4) of Section
    Twenty One (21);

WHEREAS, an Extension of Services for the area would to be annexed and contemporaneously approved by the Governing Body as required by KS.A. 12-520b.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF ELLSWORTH, KANSAS:
SECTION 1. The City of Ellsworth, Kansas is considering annexing eligible real property which is currently located in Ellsworth County, Kansas, and which is described above, to the City of Ellsworth.
SECTION 2. A report setting forth plans for extending to the area proposed to be annexed, the major municipal services available to businesses of the City of Ellsworth, Kansas is on file at City Hall, 121 W. 1st Street, Ellsworth, Kansas, and is available for inspection during regular office hours.
SECTION 3. A sketch of the property proposed to be annexed, the current and prospective city limits, the proposed location of the extension of service and neighboring properties is marked as Exhibit A, attached hereto, and is incorporated herein by this reference.
NOTICE OF PUBLIC HEARING
SECTION 4. That notice is hereby given that a public hearing will be held by the Governing Body of the City of Ellsworth, Kansas on Tuesday, November 12, 2019 at 5:15 p.m., at Ellsworth City Hall Chambers, 121 W. 1st St., Ellsworth, during which the proposal for annexation, including the plan for extension of municipal services, will be presented and comments from all interested persons shall be heard.
SECTION 5. That within 10 days following the adoption of this Resolution, the City Clerk of the City of Ellsworth, Kansas shall by certified mail serve a copy of this Resolution and a sketch of the area proposed to be annexed to all owners of land within the area proposed to be annexed and all other interested parties and entities prescribed in KS.A. 12-520, et. seq.
SECTION 6. That this Resolution and the sketch of the area proposed to be annexed shall be published once in the official city newspaper not less than one week nor more than two weeks preceding said public hearing.
ADOPTED AND APPROVED by the Governing Body of the City of Ellsworth, Kansas this 9th day of September, 2019.
