City of Ellsworth Ordinance Designating Trafficways

ORDINANCE NO. 3098

AN ORDINANCE DESIGNATING CERTAIN STREETS WITHIN THE CITY OF ELLSWORTH, KANSAS, AS MAIN TRAFFICWAYS AND MAIN TRAFFICWAY CONNECTIONS.

WHEREAS, K.S.A. 12 685 et seq. (the "Act") provides that the governing body of any city is authorized and empowered to designate and establish, by ordinance, as a main trafficway, any existing or proposed street, boulevard, avenue or part thereof, within such city, the primary function of which is, or shall be, the movement of through traffic between areas of concentrated activity within the city or between such areas within the city and traffic facilities outside the city performing the function of a major trafficway; and such designation by the governing body shall be final and conclusive; and
WHEREAS, the Act also provides that the governing body of any city is authorized and empowered to designate and establish, by ordinance, certain portions of existing streets, boulevards, avenues or viaducts as trafficway connections or to acquire by purchase or condemnation the necessary right-of-way for such purposes and designate and establish the same as trafficway connections, and to connect any street, boulevard, avenue or viaduct with any of the main trafficways and/or connect any two (2) main trafficways and designate and establish the same as trafficway connections; and that such designation by the governing body shall be final and conclusive; and
WHEREAS, the governing body of the City of Ellsworth, Kansas (the "City"), hereby finds and determines that certain streets, boulevards or avenues within the City should be designated and established as main trafficways or main trafficway connections, as provided by and under the authority of the Act.
THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ELLSWORTH, KANSAS:
SECTION 1. Designation.  It is hereby authorized, ordered and directed, under the authority of the Act, that the street, boulevard or avenue set forth is hereby designated and established as a main trafficway:
    Street Name/Location
    3rd Street within the City
    15th Street/K-140 within the City
It is hereby authorized, ordered and directed, under the authority of the Act, that the streets, boulevards or avenues set forth is hereby designated and established as trafficway connections:
    Street Name/Location
    Prospect Avenue between 15th Street 
        and 8th Street
    Grand Avenue between 15th Street and 8th Street
SECTION 2. Effective Date.  This Ordinance shall take effect and be of force from and after its passage by the governing body of the City, approval by the Mayor and publication in the official City newspaper.
PASSED by the governing body of the City on November 25, 2019 and APPROVED AND SIGNED by the Mayor.
